1. Introduction and acceptance

These Terms govern use of the Korean–Australian community information-sharing service (“KoAus”) provided by KIM SHINHAENG (MR SHINHAENG KIM) / Koaus Community. By accessing or using the service you are taken to agree to these Terms. On registration you complete a step confirming agreement to these Terms and the Privacy Policy.

2. Nature of the platform and limitation of liability

KoAus is an online platform (a “venue”) for users to share information (jobs, sharehouses, second-hand goods, vehicle and care services, etc.). The parties to any transaction or contract are the users themselves; we do not intervene in or guarantee any transaction. To the maximum extent permitted by law, we are not liable for legal or financial disputes or direct or indirect loss arising from direct dealings or use of information. These Terms do not exclude or limit consumer rights guaranteed by the Australian Consumer Law (ACL).

3. User responsibilities and prohibited conduct

You must provide accurate information. The following are prohibited: false listings or scam information; abuse, defamation or discrimination; impersonation; bot-driven spam; posting illegal or harmful content; infringing others’ rights; commercial or advertising activity without our prior consent; automated bulk collection of information or content (scraping); and copying, selling or commercially reusing information obtained from the service or other people’s personal information. All users must comply with the Online Safety Act 2021 (Cth).

You are responsible for your account and all activity that occurs under it, and must keep your mobile (SMS verification) and any linked Google account secure. Notify us immediately if you become aware of any unauthorised use of your account. You may not transfer, lend or assign your account or your status under these Terms to anyone else, or use it as security.

4. Content ownership and licence

You retain ownership of the content you post. However, you grant us a non-exclusive, royalty-free licence to use, reproduce and display that content for operating, displaying and promoting the service. “koaus” (name and logo) is a trade mark of the operator, filed with IP Australia (word mark, Classes 9 and 35), and “Koaus Community” is our registered business name. The KoAus name, logo, design and software remain our property.

Video content on the service is played via the YouTube embedded (IFrame) player, and only videos whose embedding is permitted under the YouTube Terms of Service are displayed. We do not host, copy or re-upload any video files. Copyright in each video remains with its original uploader, and if a copyright owner asks us to stop displaying their video, we will remove it from the service without delay (contact: koaus.official@gmail.com).

5. Reporting and content removal

You can report harmful or infringing content to koaus.official@gmail.com. We may remove infringing posts without prior notice and may restrict the service for, or permanently suspend, an infringing user’s account. Online safety matters may also be reported to the eSafety Commissioner (www.esafety.gov.au). If your content is removed or suspended, you may object or request reinstatement within 30 days.

6. Account suspension, termination and deletion

You may request deletion of your account at any time (see “Account & Data Deletion” below).

We may refuse registration or suspend or terminate an account where: (1) you have used another person’s identity or information; (2) you provided false information when registering; (3) you engage in conduct prohibited by these Terms or applicable law; (4) you interfere with other users’ use of the service or threaten its operation; or (5) you post fraudulent, illegal or harmful content.

Before permanently terminating an account we will, where practicable, notify you of the reason and give you an opportunity to respond. However, in urgent or serious cases — such as illegal content, fraud, safety risks, or repeated or serious breaches — we may suspend or terminate immediately without prior notice.

7. Disclaimer of warranties

The service is provided “as is”, and we do not warrant the accuracy, completeness or currency of posted information. (Consumer guarantees that cannot be excluded under the ACL are not affected.)

We may also suspend or change the service temporarily for scheduled maintenance, equipment repairs, system or network failures, force majeure or similar causes, and we are not liable for resulting loss except in the case of our wilful misconduct or gross negligence.

8. Indemnity

To the extent permitted by law, you indemnify us against loss arising from your breach of these Terms or from your content or conduct.

9. Advertising and sponsorship

We may display advertising or paid listings, and sponsored or promotional content will be identified as such. Separate advertising terms may apply to advertisers. Where such separate or service-specific terms conflict with these Terms, the separate terms prevail.

10. Notices

Unless otherwise stated, we give notices to you by the email address you have provided or by an in-service notification. Notices to users generally may be given by posting an announcement within the service, which replaces individual notice.

11. Changes to these Terms

We may change these Terms and will notify material changes in accordance with clause 10 (Notices). Continued use after a change is taken as acceptance of it.

12. Governing law and jurisdiction

These Terms are governed by the laws of the State of Queensland, Australia, and related disputes are subject to the jurisdiction of the courts of Queensland.

13. General

If any provision is invalid, the remaining provisions continue in effect. These Terms constitute the entire agreement between us and the user.

본 약관은 김신행 (Koaus Community)이 제공하는 호주 한인 커뮤니티 정보공유 서비스(“KoAus”)의 이용 조건을 규정합니다. 서비스에 접속·이용하면 본 약관에 동의한 것으로 간주됩니다. 회원가입 시 약관 및 개인정보처리방침에 대한 동의 절차를 거칩니다.

2. 플랫폼의 성격 및 면책

KoAus는 이용자 간 정보(구인구직, 쉐어하우스, 중고거래, 차량·케어 서비스 등)를 공유하는 온라인 플랫폼(Venue)입니다. 거래·계약의 당사자는 이용자 본인이며, 당사는 거래에 개입하거나 이를 보장하지 않습니다. 직거래나 정보 활용으로 발생하는 법적·금전적 분쟁 및 직간접 손실에 대해 당사는 법이 허용하는 최대 한도 내에서 책임을 지지 않습니다. 본 약관은 「호주 소비자법(ACL)」이 보장하는 소비자 권리를 배제·제한하지 않습니다.

3. 이용자의 책임 및 금지행위

이용자는 정확한 정보를 제공해야 하며, 다음 행위를 금지합니다: 허위 매물·사기성 정보, 욕설·비방·차별, 타인 사칭, 봇을 이용한 스팸, 불법·유해 콘텐츠 게시, 타인의 권리 침해, 당사의 사전 승인 없는 영업·광고 활동, 자동화 수단을 통한 정보·게시물의 대량 수집(스크래핑), 서비스에서 얻은 정보나 타인의 개인정보를 복제·판매하거나 상업적으로 재이용하는 행위. 모든 이용자는 「Online Safety Act 2021 (Cth)」을 준수해야 합니다.

이용자는 본인 계정 및 본인 계정으로 이루어진 모든 활동에 대해 책임을 지며, 본인의 휴대폰(SMS 인증) 및 연결된 Google 계정을 안전하게 관리해야 합니다. 계정의 무단 사용을 인지한 경우 즉시 당사에 알려야 합니다. 또한 이용자는 계정 또는 이용계약상 지위를 타인에게 양도·대여하거나 담보로 제공할 수 없습니다.

4. 콘텐츠 소유권 및 이용 허락

이용자가 게시한 콘텐츠의 소유권은 이용자에게 있습니다. 다만 이용자는 당사에게 서비스 운영·표시·홍보를 위해 해당 콘텐츠를 사용·복제·게시할 수 있는 비독점적·무상의 사용권을 부여합니다. “koaus” 명칭·로고는 운영자가 IP Australia에 출원한 상표(워드마크, Class 9·35)이며, “Koaus Community”는 등록된 사업자명입니다. KoAus의 명칭·로고·디자인·소프트웨어에 대한 권리는 당사에 있습니다.

서비스 내 영상 콘텐츠는 YouTube 임베드(IFrame) 방식으로 재생되며, YouTube 서비스 약관에서 임베드가 허용된 영상만 노출됩니다. 당사는 영상 파일을 직접 저장·복제·재업로드하지 않습니다. 영상의 저작권은 원 게시자(업로더)에게 있으며, 원저작권자가 노출 중단을 요청하는 경우 지체 없이 해당 영상의 노출을 중단합니다(요청: koaus.official@gmail.com).

5. 신고 및 콘텐츠 삭제

이용자는 유해·위반 콘텐츠를 koaus.official@gmail.com 으로 신고할 수 있습니다. 당사는 위반 게시물을 사전 통보 없이 삭제하고, 위반 이용자의 서비스 이용을 제한하거나 계정을 영구 정지할 수 있습니다. 호주 온라인 안전 관련 신고는 eSafety Commissioner(www.esafety.gov.au)에도 가능합니다. 삭제·중단된 게시물에 대해 이용자는 30일 이내에 당사에 이의를 제기하거나 재게시를 요청할 수 있습니다.

6. 계정 정지·해지 및 삭제

이용자는 언제든 계정 삭제를 요청할 수 있습니다(아래 ‘계정·데이터 삭제 안내’ 참조).

당사는 다음 각 호에 해당하는 경우 회원가입을 거부하거나 계정을 정지·해지할 수 있습니다: (1) 타인의 명의·정보를 도용한 경우, (2) 가입 시 필수 정보를 허위로 기재한 경우, (3) 본 약관 또는 관계 법령이 금지하는 행위를 한 경우, (4) 다른 이용자의 서비스 이용을 방해하거나 서비스 운영을 위협하는 경우, (5) 사기·불법·유해 콘텐츠를 게시한 경우.

계정을 영구 해지하기 전에는 가능한 경우 이용자에게 그 사유를 통지하고 소명할 기회를 제공합니다. 다만 불법 콘텐츠, 사기, 안전 위협, 반복적·중대한 위반 등 긴급하거나 중대한 경우에는 사전 통지 없이 즉시 정지·해지할 수 있습니다.

7. 보증의 부인

서비스는 “있는 그대로(as is)” 제공되며, 당사는 게시 정보의 정확성·완전성·최신성을 보증하지 않습니다. (ACL상 배제할 수 없는 소비자 보증은 영향을 받지 않습니다.)

또한 당사는 정기 점검, 설비 보수, 시스템·통신 장애, 천재지변 등 불가항력적 사유로 서비스를 일시 중단하거나 변경할 수 있으며, 이로 인해 발생한 손해에 대해 고의 또는 중대한 과실이 없는 한 책임지지 않습니다.

8. 배상

이용자는 본 약관 위반 또는 자신의 콘텐츠·행위로 인해 당사에 발생한 손해에 대해 법이 허용하는 범위에서 당사를 면책·배상합니다.

9. 광고 및 협찬

당사는 광고·유료 게시를 게재할 수 있으며, 협찬·광고성 콘텐츠는 그 사실을 표시합니다. 광고주에게는 별도의 광고 약관이 적용될 수 있습니다. 이러한 개별·서비스별 약관이 본 약관과 상충하는 경우 해당 개별 약관이 우선 적용됩니다.

10. 통지

당사가 이용자에게 하는 통지는 별도의 규정이 없는 한 이용자가 제공한 이메일 주소 또는 서비스 내 알림을 통해 합니다. 불특정 다수의 이용자에 대한 통지는 서비스 내 공지사항 게시로 개별 통지를 갈음할 수 있습니다.

11. 약관의 변경

당사는 약관을 변경할 수 있으며, 중요한 변경은 제10조(통지)에 따라 안내합니다. 변경 후 계속 이용하면 변경에 동의한 것으로 간주됩니다.

12. 준거법 및 관할

본 약관은 호주 퀸즈랜드주 법률을 따르며, 관련 분쟁은 퀸즈랜드주 법원의 관할에 속합니다.

13. 일반 조항

본 약관의 일부 조항이 무효이더라도 나머지 조항은 유효합니다. 본 약관은 당사와 이용자 간의 완전한 합의를 구성합니다.
